Cardano Foundation Urges EU to Rethink DeFi Rules

CardanoADA+4.00% Foundation Speaks Out on EU Crypto Rules
The Cardano Foundation has officially urged European Union regulators to take a cautious approach before expanding the region's landmark crypto legislation. Specifically, the non-profit organization is asking lawmakers not to sweep decentralized finance (DeFi) protocols and blockchain staking services under strict Markets in Crypto-Assets (MiCA) rules.
In its advisory message, the foundation stressed that regulatory frameworks should prioritize actual financial risks rather than attempting to control underlying software code and open-source networks.
Understanding Europe's MiCA Framework
The European Union introduced the Markets in Crypto-Assets regulation, commonly known as MiCA, to bring legal clarity, consumer safety, and structural guidelines to the digital asset market across member states.
While the initial phase of MiCA focuses primarily on centralized crypto businesses like exchange platforms, stablecoin issuers, and custodial wallet services, European authorities are currently considering whether to broaden this net. Future expansions could affect decentralized protocols, peer-to-peer applications, and native network staking.
Risk-Based Oversight vs. Technology Regulation
A key point highlighted by the Cardano Foundation is that effective regulation must address financial activities and risk factors, such as fraud or operational misconduct, rather than regulating software itself.
To illustrate this distinction, consider how traffic authorities regulate driving standards and speed limits to keep roads safe. They do not ban or restrict the internal mechanics of an automobile engine itself. Similarly, imposing strict compliance demands on automated code rather than targeting illegal activity can stifle technological innovation without offering genuine protection to users.
The Unique Nature of DeFi and Blockchain Staking
Decentralized finance operates through autonomous smart contracts running on public blockchains like Cardano. Unlike traditional financial institutions, true DeFi applications do not rely on central executives or intermediaries to perform transactions.
In addition, native network staking plays a critical role in securing Proof-of-Stake (PoS) blockchains. Token holders stake their assets to validate transactions and maintain ledger security, making it a vital technical function rather than a traditional banking or investment product.
Preventing Legal Uncertainty for Crypto Businesses
The Cardano Foundation warned that pushing broad or overlapping regulations onto decentralized protocols risks creating confusion across European markets.
When compliance requirements are unclear or poorly fitted to decentralized architecture, software developers and startup founders face mounting legal ambiguity. Overly rigid rules could end up driving innovation away from Europe toward regions with clearer, more customized regulatory environments.
Looking Ahead for European Crypto Policy
As lawmakers and regulators gather feedback to shape upcoming policy updates, constructive dialogue from organizations like the Cardano Foundation plays an important role in the regulatory process.
Striking the right balance between protecting market participants and encouraging software development will remain a primary focus for the digital asset ecosystem in Europe moving forward.
