Travel Rule กฎใหม่การโอนคริปโต ผู้ใช้งานต้องรู้อะไรบ้าง?

หากคุณเคยโอนคริปโทเคอร์เรนซีออกจากบัญชีบนเอ็กซ์เชนจ์ ขั้นตอนที่คุ้นเคยอาจเป็นเพียงการกรอกที่อยู่กระเป๋าปลายทาง ตรวจสอบข้อมูล แล้วกดโอน แต่ในอนาคต ขั้นตอนนี้อาจมีข้อมูลเพิ่มเติมเข้ามาเกี่ยวข้อง เพราะสำนักงานคณะกรรมการกำกับหลักทรัพย์และตลาดหลักทรัพย์ หรือ ก.ล.ต. ได้ออกหลักเกณฑ์ Travel Rule สำหรับผู้ประกอบธุรกิจสินทรัพย์ดิจิทัล ซึ่งจะเริ่มมีผลบังคับใช้ในวันที่ 27 กุมภาพันธ์ 2570
Travel Rule คืออะไร?
Travel Rule คือ หลักเกณฑ์ที่กำหนดให้ผู้ประกอบธุรกิจสินทรัพย์ดิจิทัลต้องส่งข้อมูลของผู้โอนและผู้รับไปพร้อมกับการโอนสินทรัพย์ดิจิทัล เพื่อให้สามารถตรวจสอบได้ว่า “สินทรัพย์ดิจิทัลมาจากไหน และจะไปหาใคร”
หากเปรียบเทียบกับการโอนเงินผ่านธนาคาร ธนาคารต้นทางต้องรู้ว่าเงินมาจากใครและโอนไปหาใคร ขณะที่ธนาคารปลายทางก็ต้องสามารถทราบข้อมูลที่เกี่ยวข้องกับต้นทางของเงินได้
หลักการของ Travel Rule ก็คล้ายกัน โดยผู้ประกอบธุรกิจสินทรัพย์ดิจิทัลฝั่งส่งจะต้องส่งข้อมูลของผู้โอนและผู้รับโอนไปพร้อมกับธุรกรรมให้ผู้ประกอบธุรกิจฝั่งรับ เพื่อให้สามารถติดตามเส้นทางของสินทรัพย์ดิจิทัลได้ว่า “สินทรัพย์ดิจิทัลมาจากไหน และจะไปหาใคร”
ก.ล.ต. ระบุว่า หลักเกณฑ์นี้เป็นส่วนหนึ่งของการยกระดับระบบบริหารความเสี่ยงของผู้ประกอบธุรกิจสินทรัพย์ดิจิทัล และช่วยป้องกันไม่ให้ธุรกิจถูกใช้เป็นช่องทางในการฟอกเงินหรือก่ออาชญากรรมทางเทคโนโลยี
ผู้ใช้งานต้องทำอะไรเพิ่ม?
สำหรับผู้ใช้งาน สิ่งที่เปลี่ยนแปลงชัดเจนคือ เมื่อต้องการโอนเหรียญออกจากกระเป๋าที่เปิดกับผู้ประกอบธุรกิจ จากเดิมที่อาจระบุเพียงที่อยู่กระเป๋าปลายทาง ในอนาคตจะต้องให้ข้อมูลเกี่ยวกับผู้รับเพิ่มขึ้น
–หากมูลค่าธุรกรรม ไม่เกิน 30,000 บาท ผู้ใช้งานจะต้องระบุว่าโอนไปหาใคร
–หากเกิน 30,000 บาท จะต้องให้ข้อมูลเพิ่มเติม เช่น จังหวัดหรือเมืองและประเทศที่ผู้รับอยู่ และหากผู้รับเป็นนิติบุคคล ต้องระบุเลขทะเบียนนิติบุคคลด้วย
–หากคุณเป็นผู้รับเหรียญเข้ากระเป๋าที่เปิดกับผู้ประกอบธุรกิจสินทรัพย์ดิจิทัล ผู้ประกอบธุรกิจฝั่งรับจะต้องรวบรวมข้อมูลจากผู้ประกอบธุรกิจฝั่งส่งก่อน จึงจะให้ผู้รับสามารถนำเหรียญออกจากกระเป๋าได้
ถ้าโอนเข้า-ออก Self-hosted Wallet ทำอย่างไร?
กรณีใช้ Self-hosted Wallet หรือกระเป๋าที่ผู้ใช้งานดูแลด้วยตนเอง ก็อยู่ภายใต้หลักเกณฑ์เช่นกัน โดยสำหรับธุรกรรมบางกรณีที่มีมูลค่าเกิน 30,000 บาท อาจต้องผ่านกระบวนการตรวจสอบความเป็นเจ้าของหรือการควบคุมกระเป๋า เพื่อยืนยันว่าผู้ใช้งานสามารถเข้าถึงกระเป๋านั้นได้จริง
อย่างไรก็ตาม Travel Rule ไม่กระทบต่อการซื้อขายเหรียญบนกระดานของผู้ประกอบธุรกิจ และไม่เกี่ยวข้องกับการโอนหรือถอนเงินบาท เพราะหลักเกณฑ์นี้มุ่งเน้นไปที่การโอนสินทรัพย์ดิจิทัล
หากเป็นธุรกรรมที่มีมูลค่า เกิน 30,000 บาท ผู้ใช้งานอาจต้องผ่านกระบวนการ Ownership Verification หรือการตรวจสอบความเป็นเจ้าของหรือการควบคุมกระเป๋า เพื่อยืนยันว่าผู้ใช้งานสามารถเข้าถึงหรือควบคุมกระเป๋านั้นได้จริง
Travel Rule กระทบการเทรดคริปโตหรือไม่?
Travel Rule ใช้กับธุรกรรม การโอนและรับโอนสินทรัพย์ดิจิทัล ไม่กระทบกับการซื้อขายสินทรัพย์ดิจิทัลบนกระดานของผู้ประกอบธุรกิจ รวมถึงการโอนหรือถอนเงินบาท
ทำไมประเทศไทยต้องมี Travel Rule?
เป้าหมายสำคัญของ Travel Rule คือช่วยป้องกันการฟอกเงินและอาชญากรรมทางเทคโนโลยี ยกระดับความโปร่งใสของตลาดสินทรัพย์ดิจิทัลไทย และทำให้ประเทศไทยสอดคล้องกับมาตรฐานสากลของ FATF
อีกด้านหนึ่ง หลักเกณฑ์นี้ยังช่วยให้ประเทศไทยสอดคล้องกับมาตรฐานของ FATF (Financial Action Task Force) ซึ่งเป็นมาตรฐานสากลด้านการป้องกันและปราบปรามการฟอกเงิน การสนับสนุนทางการเงินแก่การก่อการร้าย และการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง โดยประเทศไทยมีกำหนดเข้ารับการประเมินตามมาตรฐานดังกล่าวในปี 2571
ดังนั้น แม้ผู้ใช้งานอาจต้องให้ข้อมูลเพิ่มขึ้นเมื่อต้องโอนเหรียญ แต่หากเตรียมข้อมูลครบถ้วน การทำธุรกรรมส่วนใหญ่ยังสามารถดำเนินการได้ตามปกติ

Travel Rule: New Crypto Transfer Regulations — What Users Need to Know
If you have ever transferred cryptocurrency out of an exchange account, you are likely accustomed to a process that simply involves entering the destination wallet address, verifying the information, and confirming the transfer. In the future, however, this process may require additional information. This is because the Securities and Exchange Commission (SEC) has issued the “Travel Rule” guidelines for digital asset business operators, set to take effect on February 27, 2027.
What Is the Travel Rule? The Travel Rule is a regulatory framework requiring digital asset business operators to transmit the information of both the originator and the beneficiary alongside the digital asset transfer. This enables authorities and service providers to trace “where the digital assets originate and to whom they are sent.”
To draw a parallel with traditional bank transfers: the originating bank must know the sender and recipient of the funds, while the receiving bank must be able to identify the origin of those funds.
The core principle of the Travel Rule is virtually identical. The sending digital asset business operator must transmit the originator’s and beneficiary’s information together with the transaction to the receiving business operator, allowing the movement of digital assets to be tracked to determine their origin and ultimate destination.
The SEC states that this regulation forms part of an initiative to enhance risk management systems among digital asset business operators, preventing these platforms from being exploited as channels for money laundering or cybercrime.
What Additional Steps Must Users Take? For users, the most notable change occurs when transferring digital assets out of a wallet held with a regulated business operator. Rather than specifying only the destination wallet address as before, users will be required to provide additional recipient details in the future:
— Transactions not exceeding THB 30,000: Users must specify the recipient’s identity.
— Transactions exceeding THB 30,000: Users must provide supplementary information, such as the recipient’s province or city and country of residence. If the recipient is a corporate entity, its legal entity registration number must also be provided.
— Inbound transfers to an exchange wallet: When receiving assets into a wallet held with a digital asset business operator, the receiving operator must collect and verify the required information from the sending operator before releasing the assets into the recipient’s account.
How Are Self-Hosted Wallets Handled? Transactions involving self-hosted wallets (wallets managed directly by the user) also fall under the scope of these guidelines. For certain transactions exceeding THB 30,000, users may need to undergo an ownership verification process to confirm that they genuinely control or have access to the wallet in question.
Does the Travel Rule Affect Crypto Trading? The Travel Rule applies exclusively to the transfer and receipt of digital assets. It does not impact spot trading on digital asset exchanges, nor does it apply to local fiat (THB) deposits or withdrawals.
Why Is Thailand Implementing the Travel Rule? The primary objective of the Travel Rule is to prevent money laundering and cybercrime, elevate the transparency of the Thai digital asset market, and align Thailand with the international standards set by the Financial Action Task Force (FATF).
Specifically, these rules align national regulation with the FATF standards concerning Anti-Money Laundering and Countering the Financing of Terrorism and Proliferation (AML/CFT/CPF). Thailand is scheduled to undergo its FATF mutual evaluation against these standards in 2028.
While users will need to submit additional information when transferring digital assets, standard transactions can still be executed as usual provided all required details are accurately supplied.
