CFTC Orders Prediction Markets to End State Geoblocks

Picture this: you open a trade on a federally regulated prediction market while sitting on your couch at home. You then catch a flight to another state for a quick business trip, and suddenly you are completely locked out of your account. You cannot manage your trade, close your position, or add funds if prices move against you.
The Commodity Futures Trading Commission (CFTC) wants to end this exact scenario. On Thursday, Nov. 5, 2026, the federal regulator issued an official legal interpretation stating that federally regulated derivatives exchanges generally cannot block users based on which U.S. state they are in.
Written by reporter Luci Kelemen and published on Nov. 6, 2026, the news highlights a major policy shift. The CFTC has given exchanges 30 days to remove state-level geographic restrictions or present a detailed explanation as to why compliance is impossible.
As the news broke, the broader digital asset market was trading quietly. BitcoinBTC-0.47% was hovering around $75,860 (-0.41%) while EthereumETH-0.09% stood at $2,239 (-0.10%). Please remember that past performance of digital assets is not indicative of future results. Market data can be tracked on Bitkub Market.
What Did the CFTC Rule Say?
The CFTC's new guidance focuses on its Impartial Access Requirement. Under the Commodity Exchange Act (CEA), designated contract markets (DCMs)—which are federally regulated exchanges—must offer open, fair, and impartial access to all eligible participants nationwide.
According to the CFTC, domestic geoblocking violates these core rules. Derivatives markets are designed to operate as a single, uniform national market rather than a patchwork of state-by-state rules.
The CFTC gave exchanges exactly 30 days from publication in the Federal Register to eliminate state geoblocks. If an exchange believes it cannot comply, it must submit an explanation to the CFTC’s Division of Market Oversight explaining why compliance is not feasible.
This rule does not just apply to the exchanges themselves. DCMs must also ensure that brokers and third-party intermediaries routing customers to their markets do not set up their own state-level geoblocks.
"Derivatives markets must operate on a uniform basis at a national scale in order to achieve the purposes set out in the Commodity Exchange Act. Geographic access restrictions are inconsistent with those purposes and the Act’s impartial access requirements." — Michael Selig, CFTC Chairman
Why Does the CFTC Oppose Geoblocking?
In its six-page interpretation document, the agency outlined several practical problems that state geoblocks cause for everyday traders and market stability:
- Trapped traders: If a user opens a position in an allowed state and travels to a blocked state, they become unable to manage their position or meet margin calls when market conditions shift.
- Fragmented liquidity: Blocking entire states splits trading activity into smaller pools, leading to wider bid-ask spreads and worse prices for traders.
- Hurt sports contracts: Excluding local fans from a contract on whether a local team makes the playoffs removes essential trading volume from that specific market.
- Excluded local knowledge: In political prediction markets, voters living in a specific state or city often possess the best information. Blocking them harms price accuracy.
A Direct Collision with Court Injunctions
While the CFTC wants a seamless national market, its guidance arrives right in the middle of severe court battles involving prediction platform Kalshi.
California Tribal Injunction
On Nov. 4, 2026—just one day before the CFTC released its interpretation—U.S. District Judge Jacqueline Scott Corley issued a preliminary injunction against Kalshi.
The order stems from a lawsuit brought by California Native American tribes, including the Blue Lake Rancheria. The injunction strictly bars Kalshi from offering any sports-related contracts on tribal lands.
The court set a strict timeline: the tribes must send official maps of their lands to Kalshi by Nov. 13, 2026. Kalshi must then file a compliance report within 21 days proving it has successfully blocked those areas.
Michigan Penalties and Nevada Court Rulings
Kalshi is already facing mandatory geofencing elsewhere. In Michigan, a state court injunction forces Kalshi to geofence all Michigan users, backed by a severe penalty of $500,000 per day for any violations.
Kalshi previously tried to defend itself in federal court by arguing that state-level geoblocking would force it to break the CFTC's impartial access rules. However, federal courts rejected that logic.
According to legal reports from NEXTPredict, the U.S. Court of Appeals for the Ninth Circuit dismissed Kalshi's defense during a Nevada case, calling its argument a "false, all-or-nothing proposition."
State Lawsuits and Criminal Charges in Utah
Individual states are pushing back aggressive legal challenges against prediction exchanges:
- Arkansas: Attorney General Tim Griffin filed a lawsuit against Kalshi on Nov. 4, 2026, alleging violations of the state's Deceptive Trade Practices Act.
- Utah Federal Dispute: The CFTC actually sued the state of Utah in federal court to block local authorities from enforcing state gambling statutes against CFTC-regulated prediction markets.
- Utah Criminal Prosecution: Despite the CFTC's federal lawsuit, Utah prosecutors filed 13 criminal felony charges against Kalshi as a corporation, as well as its top leadership—CEO Tarek Mansour and COO Luana Lopes Lara—over sports betting offerings.
What Happens Next?
The CFTC’s 30-day clock begins once the interpretation is formally published in the Federal Register. Exchanges caught between state court injunctions and federal CFTC rules will have to submit formal hardship explanations.
However, the CFTC has not clarified how it intends to treat an exchange that maintains a geoblock due to a binding judge's order. The agency noted only that it will evaluate "the facts and circumstances of any particular case" before initiating enforcement actions.
